[Practical guide] Work Permits for Foreigners in Vietnam (2026): Conditions, Required Documents and Application Procedures

Hiring foreign employees has become increasingly common among foreign-invested enterprises, technology companies, manufacturers, and businesses seeking specialized expertise that may not be readily available in the local workforce.

Many employers assume that obtaining a work permit is merely an administrative formality. In practice, however, applications are frequently delayed due to document deficiencies, inconsistencies, or procedural issues that could have been avoided with proper preparation.

This article provides an overview of the key conditions, required documents, and application procedures for obtaining a work permit in Vietnam, together with common mistakes that often result in requests for amendment or additional submissions.

When Is a Work Permit Required?

As a general rule, foreign nationals working in Vietnam must obtain a work permit unless they fall within one of the statutory exemption categories.

Before commencing the recruitment process, employers should therefore determine whether the foreign employee is subject to the work permit requirement or qualifies for an exemption.

Conditions for Employing Foreign Nationals

Under current regulations, an employer may hire a foreign national only when a suitable Vietnamese candidate cannot be recruited for the position.

Foreign nationals may be employed in one of the following categories:

PositionKey Requirements
ManagerRelevant qualifications and management experience
Executive DirectorRelevant qualifications and executive management experience
Specialist / ExpertBachelor's degree (or equivalent) and at least two years of relevant experience
Technical WorkerRelevant technical training and practical work experience

In addition to the position-specific requirements, foreign nationals must also satisfy the following general conditions:

  • Full legal capacity
  • Adequate health for the intended position
  • No ongoing criminal sentence or pending criminal prosecution

Required Documents

The employer and the foreign national typically prepare their respective documents in parallel.

Documents Prepared by the Employer

  • Enterprise Registration Certificate
  • Written explanation of the need to employ a foreign national and work permit application documents
  • Recruitment notice and recruitment results
  • Documents evidencing the form of employment
  • Documents supporting the proposed job position and category

Documents Prepared by the Foreign National

  • Valid passport
  • Passport-size photograph
  • Health certificate
  • Criminal record certificate
  • Academic and professional qualifications
  • Proof of work experience
  • Other supporting documents depending on the specific case
Important: Documents issued by foreign authorities generally must be consular legalized, translated into Vietnamese, and notarized in accordance with Vietnamese regulations. Since this process often takes considerable time, employers should begin preparing these documents as early as possible.

Work Permit Application Process

Step 1
Prepare the Application Dossier

The employer and the foreign national review eligibility requirements and gather all necessary supporting documents. Careful preparation at this stage can significantly reduce the risk of delays later in the process.

Step 2
Publish a Recruitment Notice

Before submitting the application, the employer must publish a recruitment notice on an eligible recruitment platform for the period required by law. The notice should clearly specify:

  • Position title
  • Employment arrangement
  • Work location
  • Duration of employment
  • Required qualifications and experience

One point often overlooked by employers is that postings on social media platforms such as Facebook or Zalo do not satisfy the recruitment notice requirement for work permit purposes.

Step 3
Submit the Application

The application must generally be submitted between 10 and 60 days before the foreign national's intended commencement date. Depending on the location of the employer, the competent authority may be:

  • The Department of Home Affairs; or
  • The Management Board of the relevant industrial park, export processing zone, or high-tech zone

Most applications are currently submitted through Vietnam's online public service portal. Provided that the dossier is complete and valid, the statutory processing time is generally 10 working days.

Four Common Mistakes That Delay Work Permit Applications

Although the application process is relatively straightforward, many applications are delayed because of recurring documentation issues.

1. Failure to Demonstrate the Need to Employ a Foreign National

Employers sometimes conduct recruitment activities only as a formality or fail to retain sufficient evidence of the recruitment process. As a result, they may be unable to demonstrate compliance with the requirement to seek suitable Vietnamese candidates before employing a foreign national.

2. Inconsistencies Across Application Documents

Job titles, employment details, or personal information may differ between the employment contract, experience letters, application forms, and supporting documents. Even minor inconsistencies can result in requests for clarification or amendment.

3. Insufficient Proof of Relevant Experience

Many experience letters merely confirm a person's employment history without adequately describing the actual duties performed. In some cases, the documented experience does not sufficiently support the position being applied for in Vietnam.

4. Failure to Properly Legalize Foreign Documents

Employers often discover too late that certain foreign-issued documents require consular legalization. This can significantly delay the application timeline, particularly where additional procedures must be completed overseas.

Pre-Submission Checklist

Before submitting a work permit application, employers should verify that:

  • The recruitment notice has been published in accordance with legal requirements
  • Job titles and employment details are consistent across all documents
  • Experience letters adequately support the proposed position
  • Foreign-issued documents have been properly consular legalized
  • The health certificate remains valid
  • The criminal record certificate remains valid
  • The passport has sufficient validity

Practical Recommendations

In many cases, delays occur not because the applicant fails to meet the legal requirements, but because supporting documents have not been properly prepared from the outset.

Employers are therefore encouraged to assess eligibility early, review supporting documents carefully, and begin legalization procedures for foreign documents well in advance of the intended employment date.

A well-prepared application can significantly reduce processing delays and help employers avoid disruptions to their recruitment plans.
